    Intellectual Property Office recognises Economic Times, Starbucks, and others as well-known trademarks

    The Intellectual Property Office has recognised Economic Times as a well-known trademark, alongside Starbucks, NDTV, Matrix Comsec, and T.T. (Rikhab Chand Jain). This declaration, announced in the weekly trademarks journal on April 14, grants these brands enhanced legal protection due to their widespread recognition.

    The Intellectual Property Office has recognised Economic Times as a well-known trademark after receiving an application filed by the holding company.

    The requests were received by Registrar of Trade Marks u/r 124 of the Trade Marks Rules, 2017, for the determination of Well-Known trademarks and after consideration of the request and perusal of the documents, the same were published in TMR Journal.

    The notification has also declared Starbucks, NDTV, Matrix Comsec Pvt. Itd., and T.T. (Rikhab Chand Jain) as well-known trademarks.

    “The Trade Marks at Sr. No. 01 to 05 were published earlier in the Trade Mark Journal u/r 124(4) of Trade Marks, Rules 2017, and either no objections were filed by any person or objections, if filed, were subsequently withdrawn,” the declaration said.

    Well-known trademarks additional layer of legal protection, as compared to trademarks. This special characterisation is due to the significant recognition and reputation among the public.

    The law restricts registration of a trademark to the extent that the earlier trade mark is a well-known trademark in India and the Use of the later mark without due cause would take unfair advantage of or be detrimental to the distinctive character or repute of the earlier trademark.

    The declaration was announced in the weekly trademarks journal on April 14.
